Terms of Service

The agreement that governs your use of Hometrace.

Welcome to Hometrace. These terms of service ("Terms") explain your rights and responsibilities when using our home inspection reporting platform. By creating an account or using the service, you agree to these Terms.

1. About Hometrace

Hometrace is a software platform designed for professional home inspectors. The service enables inspectors to capture photos, generate inspection reports, and deliver those reports to their clients. Features include AI-powered photo analysis, report templates, photo organization, and client delivery tools.

2. Account Registration

To use Hometrace, you must create an account and provide accurate information including your name, email address, and business details. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. SMS Notifications

By checking the SMS consent checkbox in the application's notification settings, you explicitly consent to receive SMS text message notifications from Hometrace. These transactional messages include:

  • Inspection appointment reminders and confirmations
  • Payment confirmations and updates
  • Inspection status changes and rescheduling alerts
  • Report availability notifications

Message Frequency: Message frequency varies based on your inspection activity, typically 1-10 messages per month.

Costs: Message and data rates may apply. Check with your mobile carrier for details.

Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a confirmation that you have been unsubscribed.

Help: For assistance, reply HELP to any message or contact support@hometrace.co.

Carriers: Carriers are not liable for delayed or undelivered messages.

Opting out of SMS will not affect your ability to use the Hometrace platform, though you may miss time-sensitive notifications about your inspections.

4. Inspector Responsibilities

As a home inspection professional using Hometrace, you acknowledge that:

  • You are solely responsible for the accuracy and completeness of your inspection reports
  • AI-generated suggestions and analysis are provided as aids, not substitutes for professional judgment
  • You must review and verify all AI-generated content before including it in reports
  • You are responsible for compliance with applicable licensing requirements and standards of practice in your jurisdiction
  • You must review and customize any pre-populated template content before including it in your reports
  • Hometrace does not provide professional liability coverage for your inspection services

5. Subscriptions and Billing

Access to Hometrace requires a paid subscription. Subscription fees are displayed before purchase and are processed through our payment provider. Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. Fees are non-refundable except as required by law.

6. AI-Powered Features

Hometrace uses artificial intelligence to analyze inspection photos and suggest report content. You understand that:

  • AI analysis is provided to assist your workflow, not replace professional inspection standards
  • AI-generated content may contain errors and must be reviewed before use
  • You retain full editorial control and responsibility for all report content
  • AI features may have usage limits based on your subscription plan

7. Template and Pre-Populated Content

Hometrace provides inspection report templates that may include pre-populated notes, descriptions, and other content. This content is aggregated from publicly available inspection reports and other sources to provide a starting point for your report writing. You understand that:

  • Template content is provided as a convenience to assist in drafting your reports, not as a definitive or authoritative description of any condition
  • The accuracy, completeness, and applicability of template content to any specific inspection cannot be guaranteed
  • You are responsible for reviewing, editing, and customizing all template content to accurately reflect your findings for each specific inspection
  • Template content does not constitute professional advice and should not be relied upon as a substitute for your own observations and professional judgment
  • Hometrace assumes no liability for any template content that is used without appropriate review and modification by the inspector

8. Your Content

You retain ownership of all content you upload to Hometrace, including photos, reports, and client information. By using the service, you grant Hometrace a limited license to store, process, and display your content as necessary to provide the service. We will not share your content with third parties except as required to operate the service or as required by law.

9. Client Data and Privacy

You are responsible for obtaining appropriate consent from your clients before collecting and storing their information in Hometrace. You must handle client data in compliance with applicable privacy laws. Hometrace processes client data on your behalf as a service provider.

10. Acceptable Use

You agree to use Hometrace only for lawful purposes related to home inspection services. You may not:

  • Use the service for any unlawful purpose
  • Attempt to access other users' accounts or data
  • Interfere with the operation of the service
  • Upload malicious content or attempt to compromise system security
  • Resell or redistribute the service without authorization

We may suspend or terminate accounts that violate these Terms.

11. Intellectual Property

The Hometrace software, branding, and documentation are owned by us or our licensors. Your subscription grants you a limited, non-exclusive license to use the service for your inspection business. You may not copy, modify, or redistribute our software without permission.

12. Disclaimers

Hometrace provides software tools to support your inspection business. We do not guarantee that using our service will prevent errors in your reports or ensure compliance with any particular standards. The service is provided "as is" without warranties of any kind, express or implied.

13. Limitation of Liability

To the maximum extent permitted by law, Hometrace and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, business interruption, or claims by your clients. Our total liability for any claim related to the service is limited to the fees you paid in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Hometrace from any claims, damages, or expenses arising from your use of the service, your inspection reports, or your violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the application. Continued use of Hometrace after changes take effect constitutes acceptance of the revised Terms.

16. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will end, though you may export your data beforehand. Provisions that by their nature should survive termination will remain in effect.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.
